Terms of Service

These Terms of Service (“Terms”) are a contract between you and Clusteratech LLC (“Clusteratech”, “we”, “us”, “our”) that governs your use of Clustera Hunt (the “Service”). By creating an account you agree to these Terms.

1. Eligibility

You must be at least 16 years old to use the Service. You must provide accurate information and keep your account secure. You are responsible for everything that happens under your account.

2. The Service

Clustera Hunt surfaces job postings from public job boards, scores each posting against your profile, and — when you click “Apply” — submits an application on your behalf by automating the employer’s application form.

You remain the applicant.Every application we submit on your behalf is attributed to you. You are responsible for the truthfulness and completeness of your resume, answers, and profile. You should review the job listing before clicking “Apply” and make sure you actually want to apply.

3. Acceptable use

You agree not to:

• Submit false, misleading, or fraudulent information.
• Apply to jobs you are not genuinely interested in.
• Use the Service to send spam, harass employers, or violate any law.
• Access the Service by automated means other than the interfaces we provide, or attempt to reverse engineer or scrape the Service.
• Upload malware or any content you do not have the right to share.

4. Your content

You retain ownership of your resume, cover letters, and other content you upload (“Your Content”). You grant us a worldwide, non-exclusive license to store, process, and transmit Your Content as needed to operate the Service — including submitting Your Content to employers when you click “Apply”.

5. Subscriptions and billing

The Service has a free tier and paid plans. Paid plans are billed in advance on a recurring basis through Stripe. You can cancel any time from the billing page; cancellation takes effect at the end of the current billing period. Fees are non-refundable except where required by law.

We may change pricing with at least 30 days’ notice. Continued use after the change takes effect constitutes acceptance.

6. Employer relationships

Clustera Hunt is not the employer and is not party to any employment relationship that may result from an application. We make no representation that any employer will respond, interview, or hire you. Interview logistics, offers, and employment terms are solely between you and the employer.

7. Termination

You can close your account at any time from settings. We may suspend or terminate your account if you breach these Terms, if your use risks harm to us or to other users, or if we are legally required to. On termination, your access ends and we delete your data under the policy described in our Privacy Policy.

8. Disclaimers

The Service is provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

9. Limitation of liability

To the maximum extent permitted by law, our aggregate liability under or in connection with these Terms will not exceed the greater of (a) the amount you paid us in the twelve months before the event giving rise to the liability or (b) US$100. We will not be liable for indirect, incidental, special, consequential, or exemplary damages, including lost profits or lost opportunities.

10. Indemnity

You will indemnify and hold us harmless from any claim arising out of Your Content, your breach of these Terms, or your misuse of the Service.

11. Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any dispute will be resolved exclusively in the state or federal courts located in Santa Clara County, California, and you consent to personal jurisdiction there.

12. Changes

We may update these Terms. If changes are material, we will notify you by email or in-app at least 14 days before they take effect. The “Effective” date above always reflects the current version. Continued use after the effective date constitutes acceptance.
